Toyota Motor Company Could Face Criminal Charges

According to the USA Today, Toyota Motor Company Could Face Criminal Charges Related To Safety Recalls

Recent complaints against Toyota Motor Corporation which have triggered a federal probe into reporting of acceleration defects, a congressional investigation and a growing number of civil lawsuits may have also created the possibility of criminal charges being brought against Toyota.

The National Highway Traffic Safety Administration (NHTSA) is investigating the timeliness of Toyota's reporting of its sudden-acceleration complaints and repairs, and the Transportation Department has disclosed that it will seek the maximum civil fine of $16.4 million from Toyota.

The Transportation Recall Enhancement, Accountability and Documentation (TREAD) Act, created following the rollover recalls in 2000 involving Ford Explorers and Firestone tires, subjects individuals who intentionally mislead federal regulators about safety defects to possible criminal fines and/or prison.

Toyota has revealed that a federal grand jury in the Southern District of New York has issued subpoenas for documents relating to sudden acceleration in various Toyota vehicles and braking issues in the Prius.. The grand jury subpoenas indicate that the United States Attorney for the Southern District of New York has initiated a criminal investigation.

Can I really be arrested for yelling in my own living room?

Before the events of the last few weeks, most people would assume that the answer to that question would be “no.” 

 

Whatever your opinion regarding the actions of a Cambridge Massachusetts police officer and his arrest of Harvard Professor Dr. Henry Lewis Gates, attention is now focused on a sequence of events that occur quite commonly around the nation. 

 

Police officers have broad discretion in making arrest decisions.  In their opinion, if an individual’s behavior constitutes a crime, the police may and probably will make an arrest. 

 

Even if upon reflection, the officer’s decision to arrest was an overreaction, once an arrest occurs, it stays on your record, regardless whether the State moves forward to prosecute the arrest, or chooses to dismiss it. 

 

It is important to remember that every interaction with law enforcement has the potential for misinterpretation.  A level head and slow temper can serve you well.

Florida's Move Over Law

              Florida’s “ Move Over Law” which requires a driver to slow to 20 miles per hour below the speed limit, or change lanes away from police or emergency or towing vehicles stopped by the roadside, has been on the books since 2002. Nevertheless, results of a national survey by Move Over America reveals that 70% of drivers nationwide are unaware of the statute in effect in 46 states.

 

             The Florida Highway Patrol (FHP) has recently announced a statewide campaign to ramp up enforcement and awareness of the widely ignored law.  

             FHP representatives have expressed a “concerted effort” to enforce the Move Over Law by writing more citations in an effort to increase compliance. Last year, law enforcement agencies statewide wrote more than 6,700 tickets for violation of the law, compared with only 660 in 2005.

            The campaign also includes talk radio, advertisements and other promotional materials to raise awareness of the law. Officials with the FHP insist that the new campaign is about safety, not fee generation.  FHP Lt. Tim Firth, based in Palm Beach County, feels that drivers distracted by cellular telephones and other devices are now more dangerous to roadside emergency vehicles than ever.

Florida Law on Divorce and Children

For those who are seeking a divorce with children, the laws governing divorce in Florida changed significantly October of last year.  Most important is an acknowledgment by the courts that both parents have an important role to play in the parenting of children.  The law takes a step away from designating one parent as a primary parent and awarding visitation to the other parent.  Under the revised law, the field is leveled and parents are required to enter into a parenting plan by which the responsibilities of each parent to each other and to the children are spelled out in great detail.  Also, parents are required to prepare a timesharing arrangement for involvement in the children's activities and lives.

Many of the same rules regarding equal distribution of marital property, spousal support and the calculation of child support have remained the same.  Also remaining the same are the rules regarding the relocation of the minor children by one parent out of the geographical area where the parties reside.
